1. DEFINITIONS
"the Company" means Tracey Carr, trading as BeaBea.
"the Customer" means the person(s) with whom this Contract is made i.e. the person(s) who place the order for the goods named overleaf.
"the Contract" means the contract or agreement between the Company and the Customer for the Supply of the Goods.
"the Goods" means the Goods ordered by the Customer as described overleaf whether these are the Customers 1st 2nd or other choice.

2. PAYMENT
a. The Price for the Goods ("the Price") shall be the price quoted on the website or on any "changes/additions to order sheet".
b. The Company reserves the right not to proceed with any order unless and until all agreed deposits/monies payable up front for bespoke items have been received. Payment shall be made by cash, Paypal, Bankers draft, credit/debit card or cheque payable to "BeaBea".
c. The Customer agrees to pay the Price for the Goods at the time of order unless agreed otherwise prior to the order being accepted.
d. The Customer agrees that it shall be fully responsible and pay for all monies for which The Company becomes liable as a result of the Customer's cheques which fail to clear.

3. CUSTOMERS SPECIFICATIONS AND USE OF GOODS.
a. The Company shall not be liable for any problems caused by any inaccuracies in any instructions, specification, reference to quantities, size, or materials supplied by the Customer or by the Customers failure to make any particular specification.
b. The Company shall not be liable for any wear and tear or damage to goods once the same are delivered to the Customer including but not limited to the Customers failure to comply with any recommendations as to the use, washing or handling of Goods.

4. NON RETURNABLE GOODS
a. For reasons of hygiene the return of Bodies, Briefs, Thongs and Hosiery will not be accepted unless by reason of manufacturers fault.
b. Items ordered specially are not returnable unless by reason of manufacturers fault.

5. CANCELLATION OF ORDERS
a. Unless otherwise agreed in writing by the parties the Customer may cancel this Contract within 24 hours of placing the order.
b. If the Customer wishes to cancel the order/Contract later than 24 hours from signature thereof the Customer agrees to pay a cancellation fee of 50% of the Price of the Goods cancelled to cover costs which the Company will incur as a result of the cancellation.

6. DELIVERY
a. The Customer agrees to allow 28 days for delivery of the Goods ordered. The Company reserves the right to extend this period by written agreement with the Customer or due to any so called "force majeure" circumstances beyond the Company's control.

7. RETURNS POLICY
a. The Customer agrees that the Company will not give any refunds unless the Goods delivered to the Customer fail to comply with the Sale of Goods Act 1979 or the Sale and Supply of Goods Act 1994 or any replacements or re-enactments thereof.
b. The Customer agrees to examine the Goods on delivery and if the Customer believes the Goods are faulty or do not comply with their order the Customer agrees to inform the Company within five (5) days of delivery so the Company can take appropriate action.
c. Due to the discontinuation of certain lines a full refund will be offered if an alternate can not be agreed.
